As Long As The Transfer Is Completed Before February 28, 2023, Horses In The Care Of Any Suspended Trainer Or Affiliates May Be Transferred To A Non-suspended Trainer And Become Eligible For Earning Points On A Prospective Basis.

Furthermore, Any Points From The Race Will Be Revoked Until And Unless It Is Determined That No Violation Occurred Through A Final Regulatory Or Judicial Determination Prior To The Kentucky Derby Running If A Regulatory Body Notifies The Connections Of A Horse That Earned Points In A Road To The Kentucky Derby Race Of A Positive Drug Test Or Other Medication Violation That Could Result In Disqualification From The Road To The Kentucky Derby Race. Upon Learning Of Any Positive Drug Test Results Or Medication Violations, Connections Are Required To Immediately Notify Churchill Downs.

Points Will Be Revoked If Prompt Notification Is Not Provided. However, Any Such Designated Race Or Races May Not Contain Restrictive Provisions Relating To A Horse’s Ability To Enter Such Race Or Races, Other Than By Sex Or Age. Despite The Foregoing, Cdrt May, In Its Sole Discretion, Allocate One Or More Starting And/or Also-eligible Positions Or Otherwise Give Preference To Winners Of A Designated Race Or Races. At The Closing, The Horses Who Have Accrued The Highest Earnings In Non-restricted Sweepstakes Will Be Given Preference When Selecting The Remaining Starters And Also-eligible Horses. For The Sake Of This Preference, A “Non-restricted Sweepstakes” Is One Whose Rules Include No Restrictions Other Than Those Based On Age Or Gender. The Additional Starter(S) And/or Also-eligible Horses Shall Be Determined By Lifetime Earnings In The Case Of Remaining Ties Originating From Preferences Or Otherwise.

Cdrt Reserves The Right To Extend One Invitation To A Horse From Europe Whose Performance In Group Races In Europe Has Been Exceptional, If The Top-scoring Horse On The “European Road To The Kentucky Derby” Does Not Accept The Invitation. A Single Invitation To Compete In The Kentucky Derby Will Also Be Extended, With Preference Being Given To The Top Four Horses In The “Japan Road To The Kentucky Derby” Series In Accordance With Rules Published By Cdrt. The Invitation Will Be Extended To The Following Eligible “Japan Road To The Kentucky Derby” Top Four-point Earning Horse If A “Japan Road To The Kentucky Derby” Top Four-point Earning Horse Also Qualifies Via America’s “Road To The Kentucky Derby” Series, Which Includes The Uae Derby. If The Top-scoring Horse On The “Japan Road To The Kentucky Derby” Declines The Invitation,

A Japanese Horse With Exceptional Performance In Group Races In Japan May Get One Invitation From Cdrt. The Starter With The Highest Lifetime Earnings As Of April 15, 2023, Will Have Preference In The Event That There Are Any Ties As A Result Of The “Japan Road To The Kentucky Derby” Point System. The Starter Will Be Decided By Lot In The Case Of Remaining Ties With Lifetime Earnings. Any Horse That Is Disqualified From Competing Due To The Aforementioned Preference(S) Will Get A Refund Of Both The $25,000 Entry Fee And, If Applicable, The $200,000 Supplemental Fee. The Nominees Who Are Also Eligible To Start Under These Conditions Will Be Designated By Cdrt In Order Of Preference After The Closing (“Also Eligible Horses”).
The Also Eligible Horse With The Highest Preference (If Any), As Determined By These Conditions, Shall Become A Starter If A Starter Is Scratched From The Kentucky Derby Before 9:00 A.m. (Eastern Daylight Time) On Friday, May 5, 2023 (“Scratch Deadline”). By 11:00 A.m. Eastern Daylight Time On Monday, May 1, 2023, Churchill Downs Must Have All Starters And Eligible Horses Stabled. A Nontransferable Lot Number Will Be Drawn For Each Horse Declared A Starter At The Closing To Determine Post Positions. Each Starter’s Post Position Will Be Determined By The Lot Number Drawn For That Starter.

Despite The Aforementioned, The Cdrt May Decide To Use A Different Method To Determine Post Positions, Provided That Method Has Been Approved By The Kentucky Horse Racing Commission. For The Purpose Of Determining Post Position, Horses With Common Ownership Or Training Ties Must Be Treated Separately. After The Determination Of Post Positions And Before The Scratch Deadline, In The Event Of One Or More Scratches, (I) Starters With Post Positions Higher Than The Scratched Starter’s Post Position Will Be Moved To The Next Lowest Empty Post Position (I.e., Towards The Inside Rail Of The Race Track), And (Ii) The Also Eligible Horse That Becomes A Starter (If Any) Will Receive The Lowest Post Position Available Following The Determination Of Post Positions For The Other Starters.

The Post Positions Must Be Moved Without Changing The Order Of The Starters If One Or More Scratches Occur After The Scratch Deadline, As Determined By The Stewards And Cdrt To Be In The Best Interests Of The Safety Of The Race Participants. No Also Eligible Horses Will Be Permitted To Start. In Order To Prevent Empty Post Positions Between Horses At The Start Of The Kentucky Derby, Post Positions Must Be Moved For Each Scratch That Occurs. The Cdrt’s Racing Secretary’s Office Has Complete Rules Governing The Post-position Draw Process, And These Rules Will Be Distributed Prior To The Closing. These Guidelines Will Prevail.
